10.2.09 – CMS Publishes New FAQ on Medicare Recovery Audit Contractor Program

On September 25, 2009, the Centers for Medicare & Medicaid Services (CMS) posted a new Frequently Asked Question (FAQ) on the Medicare Recovery Audit Contractor (RAC) Program.

The new FAQ addresses the RAC discussion period. As reflected on the CMS website, the new FAQ is as follows:

How long is the Recovery Audit Contractor (RAC) discussion period?

Answer:

The discussion period begins with the time of notification (demand letter for automated reviews and the review results letter for complex reviews) through the time recoupment occurs. The discussion period normally requires written notification to the RAC. The discussion period does not extend the provider’s appeal timeframes.
